General conditions of sale

The purchase of products on the Spizzicohome.it site is governed by these General Terms and Conditions of Sale (hereinafter referred to as "CGS"), which you should carefully review before concluding a purchase order.

Seller

Spizzicohome.it is owned by the company SPIZZICO HOME SRLS, based in Casamassima (BA), SS 100, Km 18 c / o "il Baricentro" Lot 13 mod. 23 CAP 70010, having VAT number 07869010723 and REA BA-371648.

These GCS apply to all purchase orders placed on the Spizzicohome.it site, according to the methods and terms indicated in this document.

Recipiens of commercial offer

Spizzicohome.it offers products for sale to "consumers" and professionals. The sales conditions that refer to the Legislative Decree 6 September 2005 n. 206 (also called "Consumer Code") apply only to purchases made by consumers. It should be noted that "consumer" means the natural person who acts for purposes unrelated to any business, commercial, craft or professional activity carried out.

As far as professional subjects are concerned, the ordinary provisions of the Civil Code and of the regulations on distance commerce by telematics between professionals (B2B) are applied.

Please note that any order concluded implies full acceptance of the aforementioned sales conditions and that online purchases have the prepayment as an exclusive formula, therefore the Customer is required to prepay the product, including shipping costs, at the time of the sending the order, except for the cash on delivery method which, if selected by the Customer, provides for payment on delivery and in cash.

Object of the contract

The present GCS have as their object the purchase of textile articles and accessories for accommodation facilities carried out remotely by means of a telematic network ("internet") between the seller and the recipient of the commercial offer. It is specified that spizzicohome.it does not stipulate contracts with minors under 18 years.

Prices of products

All prices are in euros and can be viewed on the site with or without VAT, in reference to the quantities of the product selected by the Customer. The relative prices of the product do not include shipping and / or insurance costs, which can in any case be viewed at the time of order and before it is concluded and sent.

Prices may change at any time and without notice. These changes are attributable to market updates. The products published by spizzicohome.it are subject to the actual availability of the same, therefore the aforementioned, undertakes if there is unavailability of the product purchased by the Customer, to inform him as soon as possible by reimbursing the sums that they may have already paid.

Shipping costs are indicated in the order phase. However, if the shipment is directed to non-European countries, there may be additional charges, for example: customs duties, administrative charges, etc. These costs will be charged to the customer. Spizzicohome.it invites its customers to view the website of the Customs Agency www.adm.gov.it and to contact Customer Service, by email at: customer@spizzicohome.it to request more information.

Payments

The payment methods provided are indicated in the order form and can be chosen at the Customer's discretion. These methods include: Credit Cards, PayPal, Bank Transfer and Cash on Delivery.

The price indicated in the order form for the purchase of the products and for the relative delivery costs, will be charged to the Customer once the purchase order is concluded.

If the Customer makes payment by Credit Card, spizzicohome.it guarantees that the payment procedure will be managed by a primary payment gateway without it coming into possession of any bank or financial data of the Customer. The credit card information will only be used to execute the purchase procedure, to credit the reimbursement, if the Customer were to return the products by virtue of the right of withdrawal, or if it was necessary to report to the competent authorities the possible fraud commissioned on the spizzicohome.it site, moreover, in no case spizzicohome.it, will keep data concerning such information.

If the Customer decides to make the payment by bank transfer / postal transfer in advance, the order fulfillment procedure will be initiated once the amount of the entire order has been credited to the current account in the name of spizzicohome.it. that the time for accreditation depends on the banking institutions and is around 3-5 working days. Upon confirmation of the order, the Customer will receive an email with all the details to make the transfer. The purpose of the transfer must contain: the date and the order number - Name and surname of the ordering party.

If the Customer decides to make the payment on delivery, in addition to the payment of the product purchased, he must pay, in cash, the amount of € 9.76 as a service offered for payment to be made directly on delivery. COD orders are not accepted for orders over € 500.00 and bank checks or bank drafts are not allowed.

The receipt or invoice tax documentation can be requested no later than 15 days from the purchase, by simply sending a communication to the Customer Service, complete with all the data and the order reference to the email address: customer@spizzicohome.it.

Shipping: times and delivery

Except in the case of partial or total unavailability of the products, spizzicohome.it undertakes to send the products, by courier at the latest within 2-3 working days, from the date of the order and the verification of payment of the same by the customer.

Orders accepted will be shipped and delivered by courier selected by spizzicohome.it. To know all the details on the shipping and delivery methods of the products, you need to consult the "Delivery and Transport" section. Please read the contents of this section, as it is an integral and substantial part of these GCS and, therefore, is considered to be known and accepted in full at the time the order form is sent.

Spizzicohome.it is exempt from any liability for delays in delivery of products that are independent of the conduct of spizzicohome.it, or dependent on the service provided by the courier that handles the delivery (eg strikes, force majeure etc.).

Right of withdrawal

The right of withdrawal, outlined below, is reserved exclusively for "Consumers", is natural persons who purchase the goods not for purposes related to their professional, commercial or business activity, therefore cannot be exercised by legal persons and natural persons who they act for purposes related to their professional activity.

Regarding professional subjects, the withdrawal, in the contracts, exists only where it is expressly foreseen by the parties.

Without prejudice to the exceptions indicated below, the Customer as a "consumer, has the right to withdraw from the order, without giving any reasons, within 14 days from the day you received the ordered product (or the last product , lot or piece in the case of multiple goods, lots or pieces delivered separately) or from the conclusion of a service contract.

In case of the Customer has appointed an authorized third party to collect the goods, the right of withdrawal starts from the day of delivery of the product to the part designated by the Customer, different from the courier.

In order to exercise the right of withdrawal, the Customer must send the relative communication by simple e-mail to the address: customer@spizzicohome.it, or use the specific pre-filled form for withdrawal, available by clicking here.

The aforementioned customer is invited to send this written communication, before the expiry of the 14-day period and to proceed with the return of the returned product, within the aforementioned time frame.

Requirements for fulfilling the right of withdrawal:

The products purchased and the object of the return must be returned to the seller, following the instructions below:

1. The product must be whole and complete in all its parts, it is absolutely forbidden to remove seals or labels;

2. The product must be returned to Spizzico home srls and shipped healthy, clean, undamaged and complete with any accessories;

3. It is forbidden to use the products for "trial" purposes before making the return.

Exceptions to the right of withdrawal:

These exceptions are applied by virtue of art. 59 of the Consumer Code and refer to the customer who is a "consumer".

The aforementioned exceptions concern, by way of example but not limited to, tailored or customized products; sealed products that do not lend themselves to being returned for hygienic or sanitary reasons, or deprived of the original packaging after delivery.

In case of the Customer does not comply with the terms for the right of withdrawal and return indicated above, or the provisions previously described, Spizzicohome.it will not be required to reimburse the Customer.

The Customer is invited to consult the "Exchanges and Returns" section for further details on the methods, terms and conditions for exercising the right of withdrawal. Please note that the content of this section is an integral and substantial part of these GCS and is considered known and fully accepted by the Customer at the time the order form is sent.

Guarantees

All products sold are covered by the manufacturer's standard warranty and 24-month warranty for lack of conformity, pursuant to Legislative Decree 206/05. To use the warranty, the Customer must keep the invoice and / or receipt.

Customer service and complaints

For any need for assistance and request for information, the Customer may contact Customer Service by mail (customer@spizzicohome.it) by calling the number (+39) 02.37920030. Spizzicohome.it undertakes to respond to complaints in writing by e-mail within 3 days of receipt of the request.

Privacy policy

Spizzicohome.it aims to protect users' privacy as much as possible. To find out how to process the personal data of the user and for further information on our Privacy Policy, please refer to the "Privacy Policy" section.

Modification of the general sales conditions

If deemed necessary, spizzicohome.it reserves the right to modify or update these GCS. Therefore, we invite you to periodically consult the section on the aforementioned GCS and to read carefully before placing the order.

Applicabile law, jurisdictionand settlement of disputes

The GCS are governed by Italian law, with particular reference to Legislative Decree 6 September 2005 n. 206 (so-called "Consumer Code") and Legislative Decree 21 February 2014, n.21, as well as Legislative Decree 9 April 2003 no. 70 on electronic commerce.

According to Article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 n. 206 (Consumer Code) the Customer can use the Joint Conciliation procedure. This procedure can be started if the "consumer" has not received a reply after submitting a complaint to the company within thirty days, or has received a reply that he does not consider satisfactory.

For disputes arising from the interpretation, validity and / or execution of these GCS the mandatory territorial jurisdiction will be that of the judge of the place of residence or domicile of the "consumer", if located in the Italian territory.

In all other cases, the territorial jurisdiction, spizzicohome.it indicates as the competent court the Court of Bari.

Marks and images

Trademarks and images referable to third-party manufacturers used on this site do not belong to Spizzicohome.it and are to be considered the exclusive property of the respective owners. Any reproduction of the same is to be considered prohibited. The images of the packaging of the products are indicative and may differ in whole or in part from the originals.
